These Terms of Service govern your access to and use of the website https://thecalmchildhoodco.com.au and any digital products supplied by The Calm Childhood Co.

The Calm Childhood Co. is an Australian online business operating under ABN 36 597 637 373.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service together with our Privacy Policy, Returns and Refund Policy, Shipping and Digital Delivery Policy and any additional terms displayed on the relevant product page.

Please read these terms carefully before purchasing.

1. Eligibility

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order through our website.

By placing an order, you confirm that:

  • You are legally able to enter into this agreement.

  • The information you provide is accurate and complete.

  • You are authorised to use the selected payment method.

  • You are purchasing for lawful purposes.

Parents and carers remain responsible for choosing and supervising resources used by children.

2. Digital Products Only

All products sold by The Calm Childhood Co. are digital printable resources. No physical product will be shipped unless a product page expressly states otherwise.

Product images showing printed pages, folders, stationery, toys, learning materials, laminating, velcro, frames or other physical objects are examples of how the digital resources may be used or displayed. These items are not included unless expressly listed in the product description.

Printing, paper, ink, cutting, laminating, fastening and assembly are the customer’s responsibility.

3. Product Information

We make reasonable efforts to ensure that product descriptions, previews, age recommendations, prices and listed inclusions are accurate.

Before purchasing, you are responsible for reviewing:

  • The complete product description.

  • The listed files and inclusions.

  • The recommended age range.

  • The file format and technical requirements.

  • Whether the product is suitable for your intended use.

Age recommendations are general guidance only. Children develop at different rates, and parents or carers must decide whether an activity is appropriate for their child.

Colours, dimensions and print appearance may vary due to differences between screens, printers, ink, paper, scaling and print settings. Minor variations of this kind do not mean that the digital product is faulty.

4. Orders and Payments

Prices are displayed in the currency shown on the website or at checkout. The final price, applicable taxes, discounts and payment details will be shown before you confirm your order.

Payment must be successfully completed before digital access is provided.

We may review, decline or cancel an order where reasonably necessary because of:

  • An incomplete, declined, reversed or unauthorised payment.

  • Suspected fraud, identity misuse or payment abuse.

  • A material pricing or technical error.

  • A breach of these Terms of Service.

  • An order that cannot lawfully be completed.

If we cancel a valid paid order before supplying the product, the amount paid for that order will be refunded. This does not limit any rights available under applicable law.

Discount codes must be used according to their stated conditions. Unless expressly permitted, discounts cannot be combined, exchanged for cash or applied retrospectively.

5. Digital Delivery

After successful payment, files will be supplied electronically through one or more of the following:

  • The order confirmation or thank-you page.

  • The Orders section of a customer account.

  • A download link sent to the email address entered at checkout.

You are responsible for entering the correct email address and maintaining access to it.

You should download and securely save a personal copy of your files as soon as reasonably possible. Unless permanent access is expressly promised on the product page, purchasing a product does not guarantee indefinite third-party hosting of the download.

Delivery and access issues are handled under our Shipping and Digital Delivery Policy.

6. Personal-Use Licence

After cleared payment, you receive a limited, non-exclusive and non-transferable licence to use the purchased digital product for personal, non-commercial use within your immediate household.

Unless the product page states otherwise, you may:

  • Download and store a personal copy of the files.

  • Create a reasonable number of printed copies for children within your immediate household.

  • Create a reasonable backup copy for your own records.

  • Provide a file temporarily to a professional printing provider solely for printing copies permitted by this licence.

A printing provider must not retain, reuse, publish, sell or distribute the file.

Purchase does not transfer ownership of the product, its design or its intellectual property rights to you.

7. Prohibited Uses

Without our prior written permission, you must not:

  • Share, forward, gift, email or distribute the files to another household or person.

  • Upload the files to social media, websites, shared drives, online groups, marketplaces or file-sharing services.

  • Resell, sublicense, rent or commercially exploit any product.

  • Use the resources across a school, classroom, childcare service, tutoring business, therapy practice, playgroup or other organisation.

  • Split the cost of a product with others and distribute copies between purchasers.

  • Reproduce the product for clients, customers, students or members of a paid service.

  • Copy, extract, translate, modify or adapt the content for resale or distribution.

  • Claim the product, artwork, wording, layout or activities as your own.

  • Remove, crop, hide or alter copyright notices, purchaser details, watermarks or order identifiers.

  • Use the product or its content to create competing products.

  • Use the content to train an artificial intelligence system or generate commercial derivative materials.

  • Attempt to bypass download controls, security features or access restrictions.

If you require use by a school, educator, childcare provider or other organisation, contact us before purchasing to ask whether an appropriate licence is available.

Nothing in this section restricts a use that applicable law expressly permits and that cannot lawfully be excluded.

8. Watermarks and Protection of Digital Products

Purchased files may contain visible or invisible information identifying the original transaction or purchaser, including a customer name, email address, order number or digital watermark.

We may retain reasonable order, delivery, access and download records to:

  • Provide customer support.

  • Verify delivery.

  • Investigate suspected unauthorised distribution.

  • Protect our intellectual property.

  • Respond to fraud reports, payment disputes or chargebacks.

Personal information is handled according to our Privacy Policy and applicable law.

9. Intellectual Property

Unless otherwise stated, the website and digital products—including their text, illustrations, graphics, activities, layouts, branding and downloadable files—are owned by or licensed to The Calm Childhood Co. and are protected by applicable intellectual property laws.

All rights not expressly granted under these Terms of Service are reserved.

Unauthorised copying or distribution may result in suspension of download access, termination of the applicable licence and further action reasonably necessary to protect our rights.

10. Educational Purpose and Results

Our resources are designed to support learning, routines, communication, confidence and school-readiness activities at home.

They do not constitute:

  • A formal educational program or assessment.

  • Medical, psychological, therapeutic or developmental advice.

  • A substitute for advice from a teacher, healthcare professional or qualified developmental practitioner.

We do not guarantee that:

  • Every child will enjoy or complete every activity.

  • A child will achieve a particular academic, behavioural or developmental result.

  • A child will be accepted into, succeed at or become fully ready for a particular school or year level.

  • The same results will be achieved by every family.

A child’s lack of interest, refusal to participate or failure to achieve a particular result does not, by itself, mean that the digital product is faulty.

11. Adult Supervision and Safe Use

All resources must be used with appropriate adult judgment and supervision.

Adults are responsible for:

  • Selecting activities appropriate to the child’s age and abilities.

  • Supervising the child while resources are being used.

  • Safely operating scissors, laminators and other equipment.

  • Checking laminated edges, fasteners, adhesives, magnets, velcro and detachable pieces.

  • Keeping small parts and unsuitable materials away from younger children.

  • Discontinuing an activity if it is not appropriate or safe for the child.

The Calm Childhood Co. is not responsible for injury or damage caused by unsafe preparation, unsuitable materials, inadequate supervision or use contrary to the supplied instructions, except to the extent that liability cannot lawfully be excluded.

12. Technical Requirements

Customers are responsible for having suitable:

  • Internet access.

  • File storage.

  • PDF-reading software.

  • Devices and operating systems.

  • Printers, paper and printing supplies, where printed use is intended.

We will provide reasonable assistance with genuine problems involving the files we supplied. We are not responsible for problems caused solely by a customer’s device, software, email provider, internet connection, printer, ink, paper, storage capacity or print settings.

13. Returns, Refunds and Problems

Because digital products cannot be physically returned after being supplied or accessed, we do not generally provide refunds, returns or exchanges for change of mind.

Refund requests are not automatically approved. Requests may be assessed using the process and evidence requirements described in our Returns and Refund Policy.

Depending on the circumstances, a remedy for a genuine product problem may include technical assistance, restored access, a corrected file, a replacement file or a refund where required by law.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law or another applicable law.

14. False Claims, Fraud and Chargebacks

You must not knowingly provide false, altered, fabricated or misleading information in connection with:

  • An order.

  • A refund request.

  • A technical complaint.

  • An unauthorised transaction claim.

  • A payment dispute or chargeback.

Where reasonably possible, please contact us before opening a payment dispute so we have an opportunity to investigate and assist.

We may provide relevant order, payment, delivery, download and correspondence records to Shopify, payment providers, banks or other authorised parties when responding to a dispute.

Nothing in this section prevents a customer from exercising a legitimate right through their bank, payment provider or applicable law.

15. Suspension of Access

We may suspend or restrict access to digital files where we reasonably believe that:

  • A payment has been reversed or was unauthorised.

  • Download links or files have been shared without permission.

  • The product is being resold or commercially distributed.

  • Security controls are being bypassed.

  • These Terms of Service have been materially breached.

Where practical, we will provide notice and an opportunity to clarify the situation. If access was restricted incorrectly, we will restore it within a reasonable time.

Suspension does not remove any consumer right or remedy that cannot legally be excluded.

16. Website Availability and Third-Party Services

Our website may rely on Shopify, payment providers, digital-delivery applications, email providers and other third-party services.

We do not guarantee that the website or every third-party service will operate continuously or without interruption. We may temporarily restrict access for maintenance, security or technical reasons.

We will take reasonable steps to address interruptions affecting paid products and remain responsible for our obligations to customers as required by law.

Links to third-party websites are provided for convenience. We are not responsible for unrelated third-party content, products, practices or policies.

17. Product Corrections and Updates

We may correct errors or provide updated versions of purchased files.

Unless expressly stated in the product description, a purchase does not automatically include:

  • Every future edition of the product.

  • Newly released products.

  • New collections or expansions.

  • Additional material created after the purchase.

If we identify a material problem with a supplied file, we may provide a corrected version in accordance with our Returns and Refund Policy and applicable law.

18. Privacy

Your submission of personal information through the website is governed by our Privacy Policy.

Please do not send photographs showing a child’s face, full name, school, address or other identifying information when requesting support. Completed activity pages should be appropriately cropped or redacted before being submitted.

19. Limitation of Liability

Nothing in these Terms of Service excludes, restricts or modifies any right, guarantee or liability that cannot lawfully be excluded, including rights under the Australian Consumer Law.

To the maximum extent permitted by law, we are not responsible for indirect loss that was not reasonably foreseeable or for loss caused solely by:

  • Unauthorised or prohibited use of a product.

  • Failure to provide appropriate adult supervision.

  • Customer equipment, software, printing or internet problems.

  • Modifications made to the supplied files.

  • Events or services outside our reasonable control.

This section must be read subject to all mandatory consumer protections.

20. Changes to These Terms

We may update these Terms of Service to reflect changes to our products, website, business practices or legal obligations.

The updated version will be posted on this page with a revised effective date. Material changes will apply to future website use and purchases from their effective date.

An existing purchase will remain subject to the terms accepted when the order was completed, except where a change is required by law or gives the customer additional rights.

21. Severability and Waiver

If any part of these Terms of Service is found to be unlawful, void or unenforceable, that part will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

If we do not immediately enforce a provision, this does not mean that we waive our right to enforce it later.

22. Governing Law

These Terms of Service are governed by the laws of New South Wales and the Commonwealth of Australia.

The parties submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales, subject to any mandatory consumer rights that apply in another jurisdiction.
